Former Kaduna State Governor, Nasir El-Rufai, is set to file a no-case submission after the Department of State Services (DSS) closed its case against him in the alleged wiretapping trial.
The DSS informed the Federal High Court in Abuja on Tuesday that it would not call additional witnesses, formally ending its prosecution.
El-Rufai is facing a five-count charge bordering on alleged unlawful interception of communications after comments he made during a televised interview in February.
His lawyer, Paul Erokoro (SAN), told the court the defence would argue that the prosecution failed to present sufficient evidence to require him to enter a defence.
He also asked the court to relax El-Rufai’s bail conditions, describing them as too strict, but the request was rejected.
Justice Joyce Abdulmalik ruled that the existing bail requirements remained valid and noted that qualified sureties existed within the civil service and designated districts.
The court adjourned the case to September 22 for hearing of the no-case submission and continuation of proceedings.
