Alhaji Aminu Ado Bayero, the deposed Emir of Kano, has announced plans to approach the Supreme Court to challenge the recent verdict of the Appeal Court.
This comes after the Appeal Court nullified a Federal High Court order that had removed Muhammadu Sanusi II as the 16th Emir of Kano.
Speaking to journalists at the Nasarawa Palace of the 15th Emir of Kano, the Sarkin Dawaki Babba, Aminu Babba DanAgundi, who filed the suit that the Appeal Court struck out, criticised Sanusi’s stance on the matter.
“Sanusi did not even understand that he has completely lost out in the whole of the cases at hand,” DanAgundi remarked.
He expressed dismay over comments made by Muhammadu Sanusi II, accusing the former Emir of spreading misinformation. “That is why I expressed regrets over remarks by the 16th Emir of Kano Muhammadu Sanusi II, using the Mosque pillar to propagate something that was not true and did not happen at the Appeal Court,” he said.
DanAgundi explained that the initial case at the Federal High Court sought to nullify the repeal of certain laws by the Kano State Assembly, alleging that the legislative process was flawed.
“We initially went to Federal High Court seeking the nullification of the repeal law by the State Assembly, which we felt was done haphazardly,” he said, adding that the crux of their argument was the lack of fair hearing afforded to Bayero during his removal.
He further urged Muhammadu Sanusi II to desist from presenting himself as the Emir of Kano. “The position of Muhammadu Sanusi II that he emerged victorious was wrong. The court said that the Federal High Court has no legal right to hear issues with regards to chieftaincy affairs. But what we went to court for was different.”
DanAgundi clarified their position, stating: “We were not arguing on the powers of State Assembly to enact or repeal laws. What we were asking was lack of fair hearing on the 15th Emir Aminu Ado Bayero, that he was removed without being given the chance to protect himself. The State Assembly didn’t follow the right procedures in repealing the laws.”
He also called on security agencies, including the Police and the Department of State Services (DSS), to intervene, alleging that Sanusi was moving around with individuals he described as thugs and accusing him of plotting to disrupt peace in Kano.
According to DanAgundi, Sanusi cannot claim victory until the Supreme Court delivers its judgement.
“The Attorney General and Speaker of the Kano State Assembly went to court seeking to stop Bayero from parading himself as Emir, but the Appeal Court rejected that position and said that Bayero was not given fair hearing. By this, it clearly shows that Bayero is still the Emir of Kano,” he concluded.
