Yoruba Nation activist Sunday Adeyemo, known as Sunday Igboho, has taken his case to the Supreme Court in Abuja, challenging a ruling that nullified a N20 billion compensation awarded to him.
The case stems from a raid conducted by the Department of State Services (DSS) at his Ibadan residence in the early hours of July 1, 2021.
The operation resulted in the deaths of two individuals and extensive damage to property.
Following the raid, Igboho sued the DSS and the Attorney-General of the Federation (AGF) at the Oyo State High Court, alleging a violation of his fundamental rights.
In September 2021, the court ruled in his favour, granting him N20 billion in damages. However, in August 2022, the Court of Appeal overturned the ruling, describing the compensation as excessive.
Determined to challenge the decision, Igboho has now filed an appeal at the Supreme Court, arguing that his fundamental rights were violated.
His lawyer, Yomi Alliu (SAN), submitted the appeal on March 10, 2025, raising several legal issues.
Among his arguments, he questioned whether his case should be treated as a fundamental rights enforcement proceeding instead of a tort matter, as ruled by the lower court.
He also argued that the government failed to prove allegations against him, especially since the DSS had confiscated CCTV footage from the raid.
The appeal challenged the rejection of special damages due to a lack of valuation reports, despite affidavit evidence and expert invoices detailing the losses.
The Supreme Court will now determine whether the previous rulings were just and if Igboho’s compensation claim should be reinstated.
