The Supreme Court of Nigeria has fixed 15th of January, 2024 to hear the petition of the governorship candidate of the All Progressives Congress (APC) in Rivers State in the 2023 general elections, Patrick Tonye-Cole against the victory of the governor, Siminalayi Fubara.
Part of the prayers of Tonye-Cole is that the court should sack Governor Fubara as governor for failing to resign as Accountant General of the state after emerging the candidate of the People’s Democratic Party (PDP) in the last election.
Tonye-Cole has also argued that Fubara was not qualified to contest the last election, let alone be declared winner of the election.
In another ground, the APC governorship candidate is asking the court to cancel elections in some local government areas over allegation of irregularities or he should be declared the winner of the election
Tonye-Cole‘s suit was dismissed at the tribunal for lacking in merit in all the grounds but won some of the grounds at the Court of Appeal court before proceeding to the Supreme court.
