A Federal High Court sitting in Kano has ordered that Muhammadu Sanusi II who was recently reinstated as the Emir of Kano, should be evicted from the palace.
The court also compelled the Nigeria Police Force to take over the palace of the Emir of Kano being occupied by Ado Bayero and ensure the eviction of the former Emir.
On May 24, 2024, a Federal High Court sitting in Kano had barred the state government from enforcing the Kano State Emirate Council Repeal Law.
The presiding judge, Justice Mohammed Liman granted the order in an Exparte application in Suit No FHC/KN/CS/182/2024 brought by Alhaji Aminu Babba Dan Agundi, the Sarkin Dawaki Babba of the Kano Emirate as plaintiff against the Kano State Government; Kano State House of Assembly; Speaker of the Kano State House of Assembly; Attorney General of Kano State; Commissioner of Police, Kano State; Inspector General of Police; Nigeria Security and Civil Defence Corps; Department of State Services (DSS) as 1 – 8 defendants.
However, Justice Simon A. Amobeda, on Tuesday, barely 24 hours after the state high court gave an order to evict the deposed emirs, ordered the police to ensure all rights and privileges due to the 15th Emir of Kano, Aminu Bayero, are given to him, as the rightful Emir of Kano.
Justice Amobeda gave the order a Motion Exparte with suit FHC/KN/CS/190/2024 between His Royal Highness Alhaji Aminu Ado Bayero as Applicant and Attorney General of the Federation, the Attorney General of Kano State, Nigeria Police Force, Inspector General of Police, Commissioner of Police Kano State Command, State Security Service, Nigeria Security and Civil Defence Corps, Nigerian Army, Nigerian Navy, and Nigerian Air Force as 1 to 10th Respondents.
The judge said the order was made in the interest of justice and the maintenance of peace in Kano state.
The enrolled judgement reads in part: “Upon the Motion Exparte dated and filed on 27th day of May, 2024 coming before this honourable court praying for the following orders:
“…. “An order of interim injunction restraining the respondents either by themselves, their agents, servants, privies or any other person or authority from inviting, arresting, detaining, threatening, intimidating, harassing the applicant, raiding, tempering with or visiting the applicant’s in order to arrest or infringe on his right or in any other way infringe or attempt to infringe the Applicant’s rights pending the hearing and determination of the originating motion.
“An order restraining the 3rd, 4th and 5th respondents and all other respondents from denying the applicant to use his official residence and palace at the Emir’s Palace, Kofar Kudu as well as enjoy all rights and privileges accrued to him by virtue of being emir of Kano State and to evicting anything, anybody residing within the palace illegally pending the hearing and the determination of the originating summons.
“That this court is mindful of the order made by my learned brother, Justice Lima J. on 23rd day of May, 2024 in suit No FHC/KN/CS/182/2024.
“That is order is made in the interest of Justice and maintenance of peace in Kano State.”
The court also granted leave for the bailiff of court to serve the State Police Commissioner and NSCDC the processes in the case.
The suit has been adjourned to June 4 for a hearing.
