The Ondo State Governor, Lucky Aiyedatiwa and the Attorney-General, Mr. Kayode Ajulo and others were said to have disregarded a subsisting court order on the vacant stool of Lumure of Ayeka Kingdom in Okitipupa Local Government of Ondo State.
Starnews NG reports that the stool became vacant after the last Lumure, HRM, Oba, Fredrick Aiyelomi joined his ancestors.
However, in the process of selecting a new Monarch, it was alleged that the modalities were faulted, and the selection hit the brick wall.
Counsel to the plaintiff, Omolegbon Odusola, prayed the court for an order of injunction to restrain the Governor of Ondo State from continuing or carrying out the installation of new Lumure of Ayeka Kingdom pending when the suit will be determined.
The restraining order was granted by the High Court in Okitipupa on November 30, 2022, by Hon. Justice D. I. Kolawole.
According to the court case, suit No. HOK/45/2022 between High Chief J. E LIOPO & ORS -VS- GOVERNOR OF ONDO STATE & ORS, the restraining order obtained by the claimants against the defendants reads,” the defendants are restrained either by themselves, agents, officers, staff, successors in title or any person whosoever acting for or through them from carrying out or continuing with the selection of the new Lumure of Ayeka which selection process includes the selection of the Lumure by the kingmakers, appointment, installation, and grant of staff of office to any person pending the determination of the suit now pending before this court”
Starnews NG reports that while the court order is pending, it was alleged by the claimants that the Governor of Ondo State instructed the Okitipupa Local Government to continue with the selection process in violation of the court injunction.
In the latest development, the aggrieved individuals (claimants) have now filed a committal proceeding against the governor of Ondo State, the Attorney General and commissioner for justice, the commissioner for local government and chieftaincy affairs and the Okitipupa local government staff vide a notice of disobedience of court order dated 27th May 2024 at the court registry in Okitipupa.
The notice of the committal proceeding reads, “Take notice that unless you obey the directions contained in the Ruling of the High Court of Ondo State, Okitipupa Judicial Division, made on the 30th November 2022, in Suit No. HOK/45/2022 between High Chief J.E. Liopo & Ors -Vs- Governor of Ondo State & Ors., wherein the court restrained you, your agents, officers, staff, successors in title or any person whatsoever acting for or through you from carrying out or continuing with the selection of the new Lumure processes (a copy of which is herein attached and served on you), you wil be guilty of contempt of court and will be liable to be committed to prison.”
