Account for revenue from airport toll gates since 2015 – Court orders FAAN

 

 

 

The Federal High Court in Lagos has directed the Federal Airports Authority of Nigeria (FAAN) to reveal its revenue from toll gates and parking lots fees across all federal government-owned airports.

 

The court order stems from a suit filed by The Registered Trustees of The Centre for Law & Civil Culture, following FAAN’s refusal to comply with a Freedom of Information request.

 

Justice Ibrahim Ahmad Kala granted the public interest applicant’s request and mandated FAAN to disclose detailed revenue information from January 2015 to January 2024.

 

The judge gave the federal agency three months to comply with the order.

 

The applicant’s counsel, B.O. Fowewe, argued that FAAN’s failure to respond to the freedom of information request violated the Freedom of Information (FOI) Act, 2011. A.A. Lawal represented FAAN during the proceedings.

 

The court concluded the hearing on January 25, 2024, and at the recent session, Justice Kala declared, “The applicant’s application succeeds, and it is accordingly granted,” emphasizing that FAAN’s refusal to provide the requested information violated the FOI Act.

 

As a result, the court issued an order of mandamus, compelling FAAN to provide the applicant with detailed statements of accounts showing the total annual generated revenue from toll gates and parking lots in federal government-owned airports, along with evidence of yearly remittances from January 2015 to January 2024 within the stipulated three-month period.
