The Pan-Yoruba socio-political organization, Afenifere, has called for the immediate release of civil rights lawyer and activist, Dele Farotimi, following his arrest and detention over an alleged defamation case involving renowned legal icon Aare Afe Babalola.
In a statement released on Thursday, Afenifere’s Deputy Leader, Oba Oladipo Olaitan, and National Publicity Secretary, Prince Justice Faloye, condemned the actions of the Nigeria Police Force and the Ado-Ekiti Magistrate Court. The group described the proceedings as influenced by external pressures rather than adherence to the law.
The group emphasized that defamation is a bailable offence under Nigerian law and criticized the court’s decision to deny Farotimi bail. They also questioned the decision to try the case in Ekiti State, despite the alleged offence stemming from the publication of Farotimi’s book, Nigeria and Its Criminal Justice System, which was launched in Lagos.
“The choice of Ado-Ekiti as the trial venue appears arbitrary and legally unsound,” the statement read. “Claiming jurisdiction because the book was ‘received and read all over the world’ is both absurd and an overreach.”
Afenifere further expressed concern about the broader implications of the case, warning that it could tarnish the reputation of Afe Babalola, a revered advocate for federalism and restructuring in Nigeria. The group stated it would be unfortunate for his name to be linked to what many see as a politically motivated matter.
The organization reiterated its position that such cases should be handled as civil matters rather than criminal proceedings. They called on the police to respect judicial independence and allow the legal process to proceed without interference.
“The denial of bail and Farotimi’s subsequent remand confirm fears that this case is being driven by considerations beyond the law,” Afenifere stated. “Defamation matters belong in civil courts, where they can be fairly adjudicated.”
Dele Farotimi, who pleaded not guilty to the 16 charges against him, remains in custody. His trial has been adjourned to December 10, 2024.
